This agreement is a contract between you (the “customer”) and Lamonts which operates under the West Australian Liquor License number: 6180027151 and owns the website www.lamonts.com.au and is the supplier of wines via the website.
All orders are processed and distributed by Lamont’s. Our offers are transmitted from our licensed premises at 85 Bisdee Road MILLENDON WA 6056.
Persons under 18 years of age are not permitted to place orders for alcohol.
www.lamonts.com.au supports the responsible service of alcohol.
The terms and conditions under which you may purchase products from www.lamonts.com.au are set out below. Please read the following terms and conditions carefully before placing your order with www.lamonts.com.au.
By completing the customer application process and using the www.lamonts.com.au service, you acknowledge that you have read and understood these terms and conditions and agree to be bound by the terms and conditions of this Agreement.
PURCHASE ORDERS & DELIVERY OF GOODS
Delivery Area
Lamont’s provides delivery of goods across Australia. Lamonts Winery does not currently ship to international markets.
Orders:
To place an Order with Lamont’s Wines:
(a) Selecting Goods on www.lamonts.com.au website, entering your Personal Details and pressing the “add to cart” and “process order” button; or
(b) Selecting Goods and instructing Lamont’s by telephone that you wish to purchase the Goods, and providing your Personal Details to Lamont’s; or
(c) Selecting Goods and instructing Lamont’s by e-mail that you wish to purchase the Goods, and providing your Personal Details to Lamont’s
Authorised Receipt of Goods
Anyone at the Delivery Address who receives the Goods shall be presumed by Lamont’s to be authorised to receive the Goods on your behalf.
Under law, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over. By placing an order, the buyer confirms they are at least 18 years of age. If buying wine as a gift, the recipient must also be at least 18 years of age.
RISK AND TITLE
Upon delivery of the goods to the customers chosen address, the risk and title of the goods passes to the customer.
Returns and Refunds
If you are not satisfied with the quality of the Goods you have received from Lamont’s contact us at our cellar door on (08) 9296 4485 or email orders@lamonts.com.au within two weeks of receipt of goods.
Returns: Where wine is to be returned Lamont’s will arrange to collect the wine from the buyer at a mutually convenient time. The buyer must keep the wine in a safe and proper manner and take reasonable care of it; wine should be returned in its original packaging or packed to avoid breakage during transport back to Lamont’s.
Refunds: If a refund of product is deemed reasonably appropriate by Lamont’s, Lamont’s will refund the purchase price within 30 days of return of product to the winery.
PRICE OF GOODS & PAYMENT
Price of Goods
The price the customer will pay for goods ordered is the price specified on the product list plus delivery fees to ship the goods to the specified destination. All prices quoted are in Australian Dollars and include GST. Price variations do occur, the price paid will be the price quoted on the date of order.
Method of Payment
Lamont’s accepts payment by MasterCard, Visa, American Express and Diners Club. Transaction payments using Mastercard, Visa and American Express can be completed wholly online at www.lamonts.com.au. Transaction payments requiring Diners Club must be completed via email or telephone using the contact details provided on the website. Payment must be received in full prior to goods being dispatched.
INTELLECTUAL PROPERTY
The material displayed on www.lamonts.com.au is subject to copyright owned by Lamont’s and is protected by law. Website visitors must not do anything to prejudice the rights of the logo or graphics associated with the Lamont’s brand or any of its sub-brands.
Copyright: All content included on this site, including but not limited to text, graphics, logos, button icons, images and software is the property of Lamonts and is protected by the Commonwealth of Australia Copyright Act 1968 and other international copyright laws.
Permission is granted to display and download or print portions of the material from the site solely for your own non-commercial use or to place an order with Lamont’s.

If you (the customer) are issued with a password by Lamont’s you agree to take responsibility for the safekeeping of your password. If any unauthorised person uses your password you are liable for their use and you agree to release and forever indemnify Lamont’s in relation to any liability howsoever arising out of the unauthorised use of your password.
NOTIFICATION OF CHANGES
Lamont’s may add to, delete, or otherwise change any of the terms of this Agreement without notice. In case of a modification, the pre-existing terms and conditions continue to apply to any products ordered via the website before the change takes effect.
PROMOTIONS
Lamont’s may offer specials, promotions and discounts on www.lamonts.com.au. These promotions are available only while stocks last unless otherwise advertised.
